Last will and testament

Fees

There are no fees payable for the drafting of a Will or advice on Estate planning

Requirements for creation

  • Any person over the age of 16 and of sound mind can draft a Will without the assistance of a major
  • A Will may not include a requirement that an heir has to an illegal, immoral or other act against public policy as a condition of receipt
  • The Will must be signed at the end of each page in full and be signed in the presence of two witnesses. All writing after the signature of the testator/testatrix will be ignored

Who can make a Will?

  • Any person with an asset base of more than N$ 350 000.00 or have a reasonable expectation of accumulating assets of that value
  • A Will may not include a requirement that an heir has to an illegal, immoral or other act against public policy as a condition of receipt
  • The Will must be signed at the end of each page in full and be signed in the presence of two witnesses. All writing after the signature of the testator/testatrix will be ignored
